The Joint Controllers are responsible for the use of personal data in a secure manner and in accordance with applicable laws. The obligation to provide Clients with this information clause results from the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: RODO).

III. What is the source of my data – where is it obtained from?

We obtain personal data directly from you – you give it to us, for example, on the occasion of concluding contracts, performing the contract and on the occasion of carrying out contact through the contact form.

IV. What is the scope of personal data processed by the Joint Administrators, the purpose of processing and the duration of storage of personal data?

As we provide different services to our Clients, we process your personal data for different purposes, to different extents, and on different legal grounds as defined in the RODO. In addition, depending on the purpose for which we process your personal data, the duration of processing varies. In order to provide you with the clearest possible information, we have grouped them with reference to the purpose of processing your personal data.

  1. Purpose of processing: To conclude and perform a contract for the provision of marketing/promotional services/search engine optimization (SEO)/lead generation service/website development.
    For this purpose, personal data is processed mainly to:

    • contact the Clients to provide him with information related to the ordered services,
    • in order to duly provide marketing/promotional services/SEO search engine positioning/lead generation services/website development,
    • in order to properly perform the obligations under the contract,
    • for invoicing purposesScope of data:E-mail address, first name, last name, street, house number or premises number, country, telephone, bank account number, transaction amount, bank name. If the Client is an entrepreneur, the following data is processed: company, Tax Identification Number, street, house number or premises number, country, telephone. If you provide the name of the person placing the order on behalf of the Contractor, this data is also processed.Legal basis:The processing of your personal data is necessary for the performance of a contract for the provision of services to you. The legal basis for the processing of your personal data is Article 6(1)(b) of the RODO, i.e. the processing is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract;
      Duration of storage of personal data:We will process your personal data for the duration of the provision of services to you. We will process your data at the latest until the date of expiration of claims under the concluded contract for the provision of services.
  2. Purpose of processing: To contact Clients via the contact form
    For this purpose, personal data is processed mainly to provide you with a response in accordance with the inquiry made in the contact form.
    Scope of data: First name, last name, email address
    Legal basis: The processing of your Client’’s personal data is necessary in order to answer the question asked by you via the contact form. The legal basis for the processing of your personal data is Article 6(1)(b) of the RODO, i.e. the necessity of the consent of the data subject.to take action at the request of the data subject prior to entering into a contract, or Article 6(1)(f) of the RODO, i.e. the legitimate interest of the Joint Controllers in responding to potential Customers.
    Duration of storage of personal data: We will process your personal data for a maximum period of 3 years from the last contact, or until the expiration of any claims in the event that a Contract is concluded between the Parties.
  3. Purpose of processing: Statistics on the use of the various functionalities of the website https://mta.digital/ and https://pl.anchor.team/ and other Joint-Controllers
    Scope of data: For these purposes, we process personal data about your activities, such as:

    1. behavioral data about the use of the Joint Controllers’’ website by individual users and their preferences in this regard, the amount of time spent on the website belonging to the Joint Controllers; the number of hits on specific url’s (sub-pages) from specific phrases or media channels;
    2. data on the location of devices through which users view websites belonging to the Joint Controllers;
    3. age, gender;
    4. other data on user activity on websites owned by the Joint Controllers and on websites affiliated with it, such as comments and reviews posted, activity on social networks;
    5. e-mail address;
    6. IP address, other online identifiers of users, such as login;
    7. Name, mailing address, telephone number, company name, tax ID.

    Legal basis: Our legitimate interest (Article 6(1)(f) RODO) in facilitating the use of electronically provided services and improving the functionality of such services. The legal basis for the processing of personal data in this case is Article 6(1)(f) RODO, i.e. the legitimate interest of the Joint Controllers.
    Personal data storage time: We will process your personal data for the duration of the storage of cookies.

  4. Purpose of processing: Determination, investigation and enforcement of claims. Self-accounting.
    Scope of data: For this purpose, we may process some of the personal data you provide: Name, surname, company name, residential address, Tax ID, REGON, PESEL, data of an accounting, bookkeeping, financial nature, or data relating to the claim being asserted (data relating to the use of our services, if the claim arises from the way you use our services, other data necessary to prove the existence of the claim, including the extent of the damage suffered).
    Legal basis: our legitimate interest (Article 6(1)(f) RODO), consisting of establishing, asserting and enforcing claims and defending against claims in proceedings before courts and other state authorities. In addition, we process data on the basis of Article 6(1)(c) of the RODO in conjunction with Article 74(2) of the Accounting Act (i.e., due to the need to fulfill legal obligations, e.g., accounting, bookkeeping, tax obligations).
    Duration of storage of personal data: Data are processed for the period of limitation of claims, resulting from the provisions of the Civil Code. We process all data processed for accounting purposes and for tax reasons for 5 years calculated from the end of the calendar year in which the tax obligation arose. After the expiration of the aforementioned periods, the data is deleted or anonymized.
  5. Purpose of processing: Sending a newsletter
    Scope of data: In order to send the newsletter, we may process some of the personal data you provide: name, surname, email address, image.
    Legal basis: The legal basis for processing personal data for the purpose of sending a newsletter is the consent of the person to whom the newsletter is to be sent, expressed, for example, by checking a checkbox. The legal basis for the processing of personal data in such a case is Article 6(1)(a) of the RODO, i.e. the consent of the data subject.
    Duration of storage of personal data: Personal data processed for the purpose of sending newsletters is stored until the data subject withdraws consent. The withdrawal of consent does not affect the legality of the processing of personal data at the time before the withdrawal.
  6. Purpose of processing: Running social networks, including Facebook, Instagram, Linkedin
    Scope of data: The Joint Controllers process personal data provided by an individual on social networks, usually including: name, nickname, image, etc.
    Legal basis: The legal basis for the processing of personal data is Article 6(1)(f) of the RODO, i.e. the legitimate interest of the Joint Controllers in promoting the services offered by the Joint Controllers and undertaking other marketing activities.
    Duration of storage of personal data: Personal data is processed for the duration of an individual’s use of the pages provided by the Joint Controllers through Facebook, Instargam and other social media.
  7. Purpose of processing: Accounting, bookkeeping
    Scope of data: Personal data such as, first name, last name, company name, TIN, address, place of business, delivery address,bank account number
    Legal basis: The legal basis for the processing of personal data is: Article 6(1)(c) of the RODO. in conjunction with Article 74(2) of the Accounting Act, i.e. the need to fulfill a legal obligation incumbent on the Joint Controllers.
    Thus, the legal basis for the processing of personal data is the need for the Joint Controllers to fulfill their obligations under the law.
    Duration of storage of personal data: Personal data are processed by the Joint Controllers for the period of storage of accounting, bookkeeping, tax, personnel and payroll records. Issued personal receipts and VAT invoices are kept by the Joint Controllers until the date of expiration of tax liabilities, i.e. for 5 years, counting from the end of the calendar year in which the deadline for tax payment expired.
  8. Purpose of personal data processing: IT maintenance
    Scope of data: Data resulting from cookies, as well as all other data that the Joint Controllers process in connection with IT support (e.g., data processed using e-mail), including in particular data of Clients, Contractors, Candidates for employment.
    Legal basis: The legalizing premise is Article 6(1)(f) of the RODO legitimate legal interest of the Joint Controllers to ensure proper IT service of the services provided by the Joint Controllers. In addition, the Joint Controllers process personal data for the purpose of IT service in connection with the recruitment of associates, as well as in connection with business cooperation with Contractors.
    Storage time of personal data: Personal data are processed for the duration of the cookie storage period. The Joint Controllers may process personal data for longer if this is due to the primary purpose of the data processing (e.g., the Joint Controllers process personal data up to the date of expiration of claims under the concluded contract).

V. To whom is my personal information shared

The Joint Controllers of Personal Data, with the utmost care for the confidentiality of your personal data. Due to the necessity of fulfilling contractual obligations and ensuring the proper provision of services, personal data is transferred to the persons indicated below.

  • Service providers, including IT
    We transfer your personal data to the service providers we use for the services we provide. Suppliers supply Joint Controllers with technical, technological and organizational solutions to provide services to Clients and organizational management. The personal data you provide to us may be transferred by us to third-party IT service providers, as well as to other service providers with whom we cooperate.
  • Suppliers and partners of logistics, transportation, delivery services
    We transfer your personal data to suppliers and partners who provide logistics, transportation and delivery services to us.
  • Support for the Joint Controllers
    We may transfer your data to providers of legal and advisory services and those supporting the Joint Controllers in the enforcement of due claims (in particular, law firms). In addition, we transfer your personal data to entities that provide audit, financial, accounting, etc. services to us.
  • State bodies
    We share your personal data if we are requested to do so by authorized state authorities, in particular, organizational units of the Prosecutor’s Office, the Police, the President of the Office of Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications.

VI.  Is my data transferred outside the European Union?

Yes, we transfer your personal data outside the European Union in connection with the use of IT tools whose suppliers are based outside the European Union. If the transfer is to a third country, we ensure that the legally required standards for the protection of personal data are met in each case. VII. Is it my responsibility to provide data?

Provision of some personal data is necessary in order to use the services we offer. Provision of other data is voluntary and is not necessary for the conclusion and performance of the contract. Required information is either marked as mandatory on https://mta.digital/, https://pl.anchor.team/ or indicated as such by our employee. The consequence of failing to provide this data is the inability of us to provide certain services. Apart from the data marked as mandatory, the provision of other personal data is voluntary.

VIII.  What rights do I have?

The Joint Controllers, in connection with the processing of your personal data, ensure the exercise of your rights related to the processing of personal data, as described below. You may exercise your rights by submitting a request to the data indicated in Section 1.

  • Right to withdraw consent
    You have the right to withdraw the consent you have given for the processing of personal data, if you have given it. Withdrawal of consent has effect from the moment of withdrawal. Withdrawal of consent does not affect the processing we lawfully performed prior to its withdrawal. Withdrawal of consent has no negative consequences for you.
  • Right to object to the use of data
    You have the right to object at any time to the use of your personal data if we process your data based on our legitimate interests, such as in connection with keeping statistics on the use of particular functionalities of the website https://mta.digital/ or https://pl.anchor.team/. If your objection proves to be valid and we have no other legal basis for processing your personal data, we will delete your data against the use of which you have objected.
  • The right to erasure of data (the so-called “right to be forgotten”)
    You have the right to request the deletion of all or some of your personal data. You have the right to request deletion of your personal data if:

    • you have withdrawn specific consent, to the extent that personal data was processed based on your consent,
    • Your personal data is no longer necessary for the purposes for which it was collected or for which it was processed,
    • you have objected to the use of your data to conduct statisticsuse of Website and satisfaction surveys, and the objection has been found to be valid,

      Despite your request to delete your personal data, we may retain certain personal data to the extent necessary for the purposes of establishing, investigating or defending claims. This applies in particular to personal data including: first name, last name and email address, which we retain for the purposes of investigating complaints and claims related to the use of our services.
  • The right to restrict data processing
    You have the right to request restrictions on the processing of your personal data. If you make such a request, we will prevent you from using certain functionalities or services, the use of which will involve the processing of the data covered by the request, until the request is processed. You have the right to request the restriction of the use of your personal data in the following cases:

    • when you question the accuracy of your personal data – then we will limit its use for the time we need to check the accuracy of your data, but no longer than for 7 days,
    • When the processing of your data is unlawful, and instead of deletion you request the restriction of its use,
    • when your personal data are no longer necessary for the purposes for which we collected or used them, but are needed by you to establish, assert or defend claims
    • when you have objected to the use of your data, in which case the restriction is for the time needed to consider whether, due your particular situation, the protection of interests, rights and freedoms outweighs the interests we pursue by processing your personal data
  • Right of access to data
    You have the right to obtain confirmation from us as to whether we are processing your personal data, and if we are, you have the right:

    • access your personal information,
    • obtain information about the purposes of the processing, the categories of personal data processed recipients or categories of recipients of that data, the intended period of storage of your data or the criteria for determining that period, your rights under the RODO and your right to lodge a complaint with a supervisory authority, the source of that data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of that data outside the European Union,
    • obtain a copy of your personal data.
  • Right to rectify data
    You have the right to correct and complete the personal information you have provided. You can do this yourself in the Settings (Privacy) tab. With respect to other personal data, you have the right to request that we correct this data (if it is incorrect) and complete it (if it is incomplete).
  • Right to data portability
    You have the right to receive your personal data that you have provided to us and then send it to another personal data controller of your choice, such as another operator of similar services. You also have the right to request that we send your personal data directly to such other controller, if technically possible.

IX. At what time do we fulfill your request?

If, in the exercise of the above-mentioned rights, you make a request to us, we will either fulfill the request or refuse to fulfill it immediately, but no later than one month after receiving it. However, if – due to the complexity of the request or the number of requests – we are unable to fulfill your request within one month, we will fulfill it within another two months informing you in advance of the intended extension of the deadline.
