In connection with the commencement of the General Regulation on the Protection of Personal Data (the so-called RODO), we are sending you a package of information explaining how the Joint Administrators, i.e. MTA Digital sp. z o.o., MTA Performance sp. z o.o. and Anchor.Team sp. z o.o., process personal data of candidates for cooperation with the Joint Administrators.

We take the utmost care of the processed personal data of individuals. Caring for the protection of our Contractors’ personal data, we improve the description of procedures and technological solutions used.

Co-administrators are responsible for the use of personal data in a secure manner and in accordance with applicable laws. The obligation to provide Candidates for cooperation with this information clause results from the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: RODO).

Purpose and basis of personal data processing

We obtain your data directly from you, and if you use the support of recruitment companies, we may also obtain data from these entities. Your personal data is processed for the purpose of recruiting new associates. The legal basis for processing personal data is Article 6(1)(b) RODO – processing is necessary for participation in the recruitment process and Article 6(1)(a) RODO, i.e. based on the candidate’s consent. With regard to sensitive data (primarily, data on no criminal record), the legal premise for the processing of such personal data is Article 9(2)(b) RODO – the processing of personal data is necessary for the exercise of specific rights by the Joint Administrators related to the conclusion of Cooperation Agreements (B2B). The Joint Administrators may potentially transfer personal data to a recipient in a third country or an international organization, particularly in connection with the use of IT tools whose providers are based outside the European Economic Area. The processing of personal data will not take place on the basis of Article 6(1)(f) of the RODO – as the processing of personal data is not necessary for the purposes of the legitimate interests pursued by the Personal Data Controller. To the extent that the processing of personal data is carried out on the basis of the consent granted, the data subject is entitled to withdraw consent to the processing of personal data by the Joint Administrators, but this will not affect the legality of the processing with respect to the activities performed before the withdrawal of consent.

Categories of personal data processed

The Joint Administrators process the following categories of personal data: name, home address, mailing address, telephone number, e-mail address, work experience, education, parents’ names, date of birth. In addition, the Co-Administrators may process personal data resulting from submitted employment certificates, documents confirming professional qualifications required to perform services for the Co-Administrators, and other documents if the candidate has submitted them in connection with applying for a Cooperation Agreement. In addition, the Joint Administrators may also process special categories of personal data, i.e. criminal record data. Providing personal data is not mandatory, however, it is necessary in order to participate in the in the recruitment process conducted by the Joint Administrators. In case of failure to provide personal data, the Joint Administrators may refuse to participate in the recruitment process. Personal data is not processed for automated decision-making, including profiling. Personal data comes directly from the subject.

Entities entrusted with personal data

Your personal data may be transferred to entities that provide services to us or support us in conducting the recruitment process.

Service providers, including IT

Personal data of Candidates for employment may be transferred to service providers used by the Co-Administrators for recruitment. Suppliers supply the Co-Administrators with technical, technological and organizational solutions to enable recruitment and organizational management. We also transfer data to, among others, suppliers of servers on which personal data is stored. Support for Co-Administrators Candidates’ personal data may be transferred to providers of legal and consulting services and those supporting the Joint Administrators in the enforcement of due claims (in particular, law firms).

Processing time for personal data

Personal data is deleted by the Joint Administrators of Personal Data at the end of the recruitment process, whereby personal data may be processed until the expiration of possible claims. In the case of consent to the processing of personal data for future recruitment, the data will be processed until the date of revocation of consent to its processing.

Your rights in relation to the processing of your personal data by the Joint Controllers

You have the right to request from the Joint Controllers of Personal Data:

  • Access to the processed data,
  • rectification of processed personal data,
  • deletion of processed personal data
  • limitation of personal data processing,
  • The right to object to personal data processing activities.

The above-mentioned rights can be exercised by submitting an appropriate request to the Joint Administrators for the data indicated in Section I. In addition, you are entitled to request that your personal data be transferred to another controller, however, only on the condition that the processing will take place by automated means and that it is technically possible. The processing of personal data will not be carried out on the basis of consent for processing.

The right to file a complaint with the supervisory authority

If the processing of personal data violates the law, you have the right to file a complaint with the supervisory authority about the processing of personal data by the Joint Data Controllers. Complaints can be submitted to the President of the Office for Personal Data Protection (Office of the President of the Office for Personal Data Protection 2 Stawki Street, 00-193 Warsaw).
